User Agreement
1. Introduction
Welcome to ComeMarket, an international e-commerce marketplace. This Agreement (“Agreement”) outlines the terms and conditions governing your use of the ComeMarket platform, including buying and selling activities. By accessing ComeMarket, you accept these terms. If you do not agree, you may not use the platform.
2. User Eligibility
- Age and Registration: Users must be at least 18 years old. Users must provide accurate information at registration and keep it up-to-date.
- Account Responsibility: Users are responsible for maintaining their account’s security and for any activities occurring under their account.
3. Account Types and User Roles
- Buyer and Seller Accounts: Buyers can make purchases, while Sellers have additional privileges to list and sell products.
- Company Accounts: Companies may register on behalf of a business entity, assuming full responsibility for account activities.
4. Platform Usage Rights and Restrictions
- Permitted Use: Use ComeMarket solely for legal transactions, including listing, buying, and selling permitted products.
- Prohibited Activities: Users must not engage in fraudulent behavior, misrepresentation, or infringe on others’ intellectual property.
5. Fees and Payment Terms
- Listing and Transaction Fees: ComeMarket does not charge any listing or transaction fees for most product categories. However, commissions may apply to specific categories, including Transport and Real Estate. Any applicable fees will be clearly communicated to sellers in advance.
- Payment Processing: Payments are processed through ComeMarket’s approved methods, with payouts scheduled for sellers as per the policy.
- Refunds and Disputes: Refunds may be issued in cases of verified disputes. ComeMarket offers dispute mediation as needed.
6. Seller Obligations and Product Listings
- Product Listings Requirements: Each product must be accurately described, including details and images.
- Prohibited Products: Illegal or restricted products are not allowed, including counterfeit and hazardous items.
- Order Fulfillment and Shipping: Sellers must fulfill orders promptly and provide tracking details where applicable.
- Returns and Refunds Policy: Sellers must have a clear policy for returns, refunds, and exchanges, compliant with ComeMarket guidelines.
7. Buyer Obligations
- Purchasing Process: Buyers should carefully review product details and respect sellers’ policies.
- Returns and Disputes: Buyers can request returns or refunds as per the seller’s policy, with ComeMarket available for dispute resolution.
8. Intellectual Property Rights
- Content Ownership: Users retain ownership of content they create, but grant ComeMarket a license to display it.
- Copyright Violations: Users can report copyright violations via our DMCA policy.
- Trademark Guidelines: Users must avoid using ComeMarket’s trademarks without written permission.
9. Privacy Policy and Data Handling
- Data Collection: ComeMarket collects data necessary to enhance user experience and comply with regulations.
- Data Usage: Data is used to improve platform features, support transactions, and personalize user experience.
- User Rights: Users have rights to access, update, or delete their data, as outlined in the Privacy Policy.
10. Dispute Resolution and Legal Compliance
- Dispute Resolution Process: Disputes may be handled through our internal dispute resolution process or, if needed, arbitration.
- Jurisdiction: This Agreement is governed by the laws of the State of Wyoming, USA. Any disputes shall be resolved in the courts of Wyoming, USA.
- Compliance with Local Laws: Users must comply with local laws when engaging in transactions on ComeMarket.
11. Termination of Agreement
- Voluntary Account Closure: Users may close their accounts through account settings.
- Platform-Initiated Termination: Accounts may be suspended for violating terms or for fraudulent activities.
- Effects of Termination: Upon termination, all listings will be removed, and access to the platform will cease.
12. Limitation of Liability and Indemnification
- ComeMarket’s Liability: ComeMarket is not liable for damages arising from transactions or platform downtime.
- Indemnification: Users agree to indemnify ComeMarket for claims resulting from their use of the platform.
13. Amendments to the Agreement
- Modification Rights: ComeMarket reserves the right to modify this Agreement. Users will be notified of significant changes.
- Acceptance of Changes: Continued use of the platform implies acceptance of the modified Agreement.
