2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3. ComeMarket reserves the right to suspend or terminate accounts in cases of fraudulent activity, violation of these Terms, or suspected illegal behavior.
3. Use of the Platform
3.1. ComeMarket provides a digital marketplace for listing, buying, and selling permitted products.
3.2. You agree to use the platform only for lawful purposes and in compliance with applicable laws and regulations.
3.3. It is prohibited to use the platform for misleading, fraudulent, or illegal activities, including the sale of counterfeit or restricted goods.
3.4. Prohibited Items: Users are strictly prohibited from listing or selling illegal, counterfeit, stolen, or restricted goods. This includes items that violate intellectual property rights, hazardous materials, or any products prohibited by applicable law. The list of prohibited items may be updated by ComeMarket at any time, and users are responsible for reviewing it. ComeMarket reserves the right to remove such listings without prior notice.
4. Listings, Transactions, Payments
4.1. Sellers are responsible for ensuring that product listings are accurate, lawful, and do not infringe on third-party rights.
4.2. All transactions must be conducted through ComeMarket’s approved payment methods.
4.3. Platform Role: ComeMarket acts solely as an intermediary platform that facilitates transactions between buyers and sellers. ComeMarket is not a party to any transaction and does not assume responsibility for the actions, products, or services of users.
4.4. Subscription Model and Fees: ComeMarket operates on a subscription-based model. Sellers may be required to purchase a subscription plan to list and sell products. No transaction-based commissions are charged, except for specific categories (e.g., Real Estate, Vehicles, and others as specified on the platform), where additional fees or commissions may apply. All fees and subscription details are clearly displayed on the platform.
4.5. Billing and Renewal: Subscriptions may be billed on a recurring basis depending on the selected plan. Users are responsible for managing their subscription and may cancel at any time. No refunds are provided for partially used subscription periods unless required by law.
4.6. Disputes: Any disputes between buyers and sellers should be resolved directly between the parties. ComeMarket may assist at its discretion but is not obligated to do so.
4.7. Returns and Refunds: Returns and refunds are handled according to the seller’s individual policies. ComeMarket is not responsible for refund decisions made by sellers.
5. Seller Responsibilities
5.1. Sellers are solely responsible for the accuracy, legality, and completeness of their listings.
5.2. Sellers must comply with all applicable laws and regulations.
5.3. Sellers are responsible for shipping, delivery, returns, and communication with buyers.
5.4. Sellers must not engage in fraudulent or misleading practices.
5.5. ComeMarket reserves the right to suspend or terminate seller accounts for violations without prior notice.
5.6. Sellers are solely responsible for determining, collecting, and remitting any applicable taxes for their sales.
6. Intellectual Property
6.1. All content, trademarks, and intellectual property displayed on the platform remain the property of their respective owners.
6.2. Users may not copy, reproduce, or distribute any content without prior written consent.
6.3. By uploading content, users grant ComeMarket a non-exclusive license to use and display it for platform operations.
7. Limitation of Liability
7.1. ComeMarket is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the platform.
7.2. The platform is provided “as is” and “as available” without warranties of any kind.
7.3. ComeMarket does not guarantee uninterrupted or error-free operation.
7.4. To the fullest extent permitted by law, ComeMarket’s total liability shall not exceed the total fees paid by you to ComeMarket in the six months preceding the claim.
8. Termination
8.1. Users may close their accounts at any time.
8.2. ComeMarket may suspend or terminate accounts at its sole discretion, including in cases of suspected fraud or violations.
8.3. Upon termination, all user rights under these Terms will cease immediately.
9. Governing Law & Jurisdiction
9.1. These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles.
9.2. Because ComeMarket operates globally and our Data Controller is based in the USA, your data may be processed in the USA. However, we fully respect and comply with the General Data Protection Regulation (GDPR) for users in the European Union.
9.3. Any disputes arising from or relating to these Terms shall first be resolved through good-faith negotiation. If unresolved, the dispute shall be submitted to the exclusive jurisdiction of the courts located in Casper, Wyoming, USA.
9.4. Users located in the European Union retain all rights granted to them under the GDPR, including the right to lodge a complaint with their local data protection authority (for you, this is the Garante per la protezione dei dati personali in Italy).
